RE: Your Purchase of Real Estate Located at (the “Property”)
Thank you for selecting our firm to represent you in your purchases of the above-referenced Property. I look forward to assisting you in a smooth and rewarding transaction.
I would like to take this opportunity to tell you what you can expect in this closing process. As your closing attorney, I will perform a title search of the Property, obtain a title insurance commitment and prepare loan documents on your behalf. My fee for these services is $650 (however, please note that if you or your agent have requested a close date within 14 days of your initial contact with our office, an expedited fee of $150 will be charged.). Out of pocket expenses for a survey, termite report, home inspection, title insurance premium, hazard insurance premium, express mail, fax and recording fees are NOT included in my legal fee.
Most closings do not require any work beyond the title search and the loan document preparation; however, in the event additional work becomes necessary, such as the drafting of an escrow agreement, an encroachment agreement, mobile home affixations or other additional documentation, a separate fee will be charged in accordance with the nature and complexity of the work involved. Of course, I will talk to you before beginning any such work to discuss my role and the costs.
PLEASE BRING CERTIFIED FUNDS FOR CLOSING IN BANK CHECK FORM MADE OUT TO: GOINS LAW, TRUST ACCOUNT OR CONTACT US DIRECTLY FOR WIRING INSTRUCTIONS. You are welcome to obtain and bring your certified funds after closing if you cannot obtain a final funds amount from my office in time to get a check from your bank.
I offer all buyers two options regarding the type of title search I will perform: 1) A title update exam which is included in the legal fee quoted above or 2) a full search comprised of a 30 year examination of the public records for an additional charge of $400.00. A title update search begins with the date and time of issuance of your seller’s prior title insurance policy. This means that I will not search the public records pertaining to the subject Property prior to the issuance of the existing title insurance policy. I, therefore, do not certify the status of the title prior to this date, so I will not be able to detect any title defects, clouds on title, encumbrances and the like which may later give rise to a claim against your title. Nonetheless, your title insurance company should cover you as to all claims that are not excepted from the policy, even if such claims arise out of defects or encumbrances, which occurred prior to the search period.
The advantage of a 30 year search over the updated search is that it gives you more certainty about the status of your title. Even if the title company agrees to provide you with full coverage and pays for your attorney’s fees and damages, you may still endure the stress of litigation and uncertainty about your ownership rights to your home. A full search, in short, simply gives you more peace of mind.
If you would prefer a full search, please notify me by email within seven (7) days from the date of this letter so that I may have sufficient time to perform this service for you.
PLEASE BE AWARE THAT OUR SEARCH DOES NOT INCLUDE MATTERS: (1) WHICH WOULD HAVE BEEN UNCOVERED BY A SURVEY, INCLUDING BUT NOT LIMITED TO YOUR PROPERTY LINES AND THE ACREAGE OF YOUR PROPERTY; (2) MATTERS OF ZONING, ENVIRONMENTAL HAZARDS, AND (3) THE STATE OF THE PROPERTY WITH REGARDS TO ANY TENANCIES AND/OR LEASE AGREEMENTS THAT MAY EXIST.
Upon receiving the completed and accurate Buyer Information Request Form from you, we will begin our title work either: (1) when your due diligence period, if any, expires; or (2) when you or your agent tells our office to begin the search. PLEASE UNDERSTAND THAT WE WILL CHARGE FOR ALL WORK PERFORMED FOR YOU EVEN IF YOUR TRANSACTION FAILS FOR ANY REASON. If you are not certain about your transaction, we suggest you contact us to delay our work for you. Please understand that if we must delay our work for you your scheduled closing, we will probably be required to reschedule your closing.
